In accordance with Senate Bill 98, the district shall notify all students, faculty, staff, and other campus community members who work on campus when the presence of immigration enforcement is confirmed on campus, to the fullest extent consistent within state and federal law.

Immigration enforcement refers to any federal effort to investigate, detain, question, or take custody of individuals for the purpose of enforcing civil or criminal immigration law. This includes the confirmed presence of federal immigration agents on campus acting in an official enforcement capacity.

District personnel will not disclose personal or immigration status information to immigration enforcement or others, except as required by state or federal law.

Notification Process

The initial notification shall be provided via the district’s emergency notification system (WVM-ALERT). Depending on the circumstances, one of the two messages will be sent district-wide:

  • Federal law enforcement activity is occurring on the (WVC or MC) campus – date/time. For more information and resource assistance see here.
  • Immigration and Customs Enforcement activity is occurring on the (WVC or MC) campus – date/time. For more information and resource assistance see here.

The district police will notify the designated College Administrator at the affected campus about the presence of immigration enforcement and assist as needed with additional messaging.

The campus designated College Administrator will post additional necessary details about the enforcement and resource information on the district website.

If there is reason to suspect that a student, faculty member, or staff member has been taken into custody as the result of an immigration action, district personnel shall notify the person’s emergency contact that the person may have been taken into custody.

The Vice President of Student Services shall designate a staff person as a point of contact for any student, who may or could be subject to an immigration order or inquiry.

The District Vice Chancellor, Human Resources shall designate a staff person as the point of contact for any faculty member, or staff person, who may or could be subject to an immigration order or inquiry.

District personnel shall not discuss the personal information, including immigration status information, of any student, faculty member, or staff person with anyone, or reveal the personal information to anyone, unless disclosing this information is permitted by federal and state law.

District personnel shall maintain a contact list of legal service providers who provide legal immigration representation and provide this list free of charge to any student who requests it. At minimum, the list shall include the legal service provider’s name and contact number, e-mail address, and office address.
